How to minimize the impact of a workers' comp claim

As a business owner, you have a lot to manage on a day-to-day basis. At some point, you will probably have an employee injury and a claim brought against your company. If you are facing a workers' comp claim, you need to make some important considerations about the impact this could have. Here are 3 tips for reducing the effect on your business:

1. Prepare yourself beforehand.

Preparation is everything when it comes to legal matters. Refer to your own company policy on workers' comp claims and how injuries must be reported to make sure this policy was followed. Gather up any reports or evidence of the employee's injury as well. Then review your insurance policy so you fully understand what your insurer covers. You also need to understand Kentucky's workers' comp laws. If you make a misstep regarding any policies or laws, you could complicate your case.

2. Try to reach a settlement out-of-court.

Usually, you do not want your case to go to court. The costs associated with litigation can add up quickly and the case could take quite a while to settle. Many employees will not want to go to court either, for similar reasons. If you negotiate outside of court, you have more control over the settlement amount. Even outside of court, an attorney can help you reach the best outcome and protect your business interests.

3. Increase your safety measures.

After the case is settled, it would be wise to reduce the risk of future injuries. There are many ways to reduce injuries and you can also increase safety measures that are already in place. Is the workplace uncluttered with clear paths to walk through? Do you have training on safety? Do you have equipment or company practices that need to be inspected/evaluated more often? How did the employee in your workers' comp case get injured? How can similar injuries be prevented?

No matter the circumstances of your workers' comp case, a strong legal advocate will only benefit you. A claim could spell disaster for a company if handled incorrectly. An employment law attorney is able to guide you on the nuances of the law and create strong defenses for your case.
