Understanding employers' tax form obligations

As you are probably aware, the tax season does not merely involve filling out your own forms and submitting them to the IRS before the deadline. At this time of year, you and other Kentucky employers will need to make sure your employees receive their W-2 forms before the due date. Our team at VanAntwerp Attorneys, LLP, understands the complex processes that tax season entails for employers and staff alike.

Many employees are looking forward to receiving their Form W-2 so they can file their tax returns. The deadline to file for taxes is April 15 every year, but as an employer, you have an earlier deadline to meet. The Internal Revenue Service's website points out that January 31 is the due date for getting Form W-2 out to your employees. This year, January 31 falls on a weekday, so this is your exact due date. During times in which the 31st lands on a holiday or weekend, the deadline will be the next business day.

The W-2 form does not necessarily have to be in your employees’ hands by this date, however. You are required to have the form officially postmarked and in the mail by January 31. Alternatively, you may decide to deliver the forms by hand to your staff while they are at work, or to email them. If you decide to electronically send Form W-2, it may be wise to inform your employees and tell them to check their spam folders if they do not see the email by January 31.
